These Terms of Service (“Terms”) govern your access to and use of the websites, products, and services offered by Book Fairy Tales (“we,” “us,” or “our”) (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Eligibility and parent responsibility
The Services are intended for use by adults who are at least 18 years old (or the age of majority in their jurisdiction) and who act as parents or legal guardians. If you allow a child to use the Services, you represent that you have authority to agree to these Terms on behalf of yourself and the child, and you accept responsibility for the child’s use. Accounts for children under 13 must be created and managed through a parent account where required by law.
Accounts and security
You may need to register for an account to access certain features. You agree to provide accurate information and to keep your credentials confidential. You are responsible for activity that occurs under your account. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial use in accordance with these Terms. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Services.
User content
If you submit suggestions, feedback, or other materials to us, you grant us a worldwide, royalty-free license to use, reproduce, and display such materials to operate and improve the Services, without obligation to you, except where prohibited by law. You represent that your submissions do not violate third-party rights.
Termination
We may suspend or terminate access to the Services if you violate these Terms or if we discontinue the Services or your account in accordance with applicable law. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitations of liability.
Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50), EXCEPT WHERE PROHIBITED BY LAW.
Indemnity
To the extent permitted by law, you will indemnify and hold harmless Book Fairy Tales and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of third-party rights.
Governing law and disputes
These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules, except where mandatory consumer protection laws in your jurisdiction require otherwise. Courts in Delaware (or another forum we designate in an updated version of these Terms) may have exclusive jurisdiction over disputes, unless applicable law requires a different forum. Nothing in these Terms limits rights you may have as a consumer that cannot be waived by agreement.
Changes to these Terms
We may modify these Terms from time to time. We will post the updated Terms on this page and update the effective date. If changes are material, we will provide additional notice as appropriate. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
Miscellaneous
These Terms constitute the entire agreement between you and us regarding the Services and supersede prior agreements on the same subject. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
